Refund policy

1. Return & Exchange Policy

1.1 Throughout this Policy, the terms “we”, “us” and “our” refer to Athleyz Pty Ltd.

1.2 “you” and “your” are a reference to the Purchaser of the Products or Services;

1.3 We are happy to offer you a refund or exchange on most purchases. The following conditions apply for returns:

  • Product is returned within 30 days from date of delivery for online orders.
  • Proof of purchase is provided with the returned product.
  • The product is unworn, unwashed and unused, in its original condition with all tags and protective packaging intact.
  • For swimwear, all hygiene stickers and tags are intact. Swimwear returns will be assessed prior to any refunds being processed.
  • A $2.50 AUD/NZ/USD processing fee applies to every return, except in cases of confirmed manufacturing defects or where otherwise stated.
  • PayPal purchases are valid for refund only. We cannot offer an exchange on PayPal purchases.

1.4 Our policy does not apply to the following products:

  • Due to health and hygiene reasons, we are unable to refund or exchange any swimwear or underwear products without the hygiene stickers intact for change of mind.
  • Final Sale and Clearance items - Final Sale or Clearance applies to items that have been marked down to clear, this includes items purchased with a further discount on the already marked down price. Final sale or clearance items will be marked on the product page (online) and on the receipt. By purchasing a final sale or clearance item, you agree that the item cannot be exchanged or refunded for a change of mind.
  • Products purchased at a further discount due to a fault that was identified at the time of purchase.
  • Gift card/voucher purchases.
  • Alterations, dry cleaning, gifting and delivery service charges or fees.
  • Any custom made, custom processed or custom acquired Products cannot be refunded or exchanged.

1.5 Returns are further subject to the following terms & conditions:

  • Delivery costs to return the Product to us are the responsibility of you, unless stated otherwise.

 

2. Return Process

2.1 To start a return, logon to our returns & exchange portal on https://www.athleyz.com/apps/order/returnpage and follow the instructions or you can contact us at support@athleyz.com.

2.2 If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

2.3 Returns & exchanges will need to be sent to the following address: 41 Cronulla Street, Suite 477, Cronulla, NSW 2230, Australia.

2.4 We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days.

2.5 Please remember it can take some time for your bank or credit card company to process and post the refund too. If more than 15 business days have passed since we’ve approved your return, please contact us at support@athleyz.com.

2.6 If you are returning Products from an International location (outside of Australia), please ensure that you clearly mark on the customs declaration that the Products contained in the package are “Returns” to us to prevent the package incurring customs charges. If the Products are not marked as “Returns” and we incur a customs charge, we may refuse to accept delivery of the Products unless the cost is met by you.

 

3. Consumer Guarantee

3.1 Our Policy as set out herein shall be subject to the requirements of the Australian Consumer Law, and where applicable shall be modified to the extent necessary to comply with the Australian Consumer Law and shall be supplemented where necessary to provide any additional rights and obligations upon us and you where necessary to comply with the Australian Consumer Law.

3.2 Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.

 

4. Definitions

4.1 “Athleyz” means Athleyz Pty Ltd ACN 678 001 093 or any member of the Athleyz Group as the context may require (and any reference to “we”, “us” and “our” is also a reference to Athleyz); and

4.2 “Athleyz Group” means the group of related bodies corporate of Athleyz Pty Ltd which carries on the business of design, importation, marketing and distribution of the Products;

4.3 “you” and “your” are a reference to the Purchaser or a User of the Websites;

4.4 “Products” means the products which Athleyz may be supplied to you pursuant to these Terms and Conditions;

4.5 “Purchaser” shall mean a person, firm, or corporation, jointly and severally if there is more than one, purchasing Products by placing an order on the Websites;

4.6 “Seller” shall mean either Athleyz or such other member of the Athleyz Group which is selling the Products/Services as the case may be;

4.7 “Services” means the services which Athleyz may be provided to you pursuant to these Terms and Conditions;

4.8 “User” means any person who accesses the Websites.
